DIGITAL MODERNIZATION OF THE CIVIL LAW INSTITUTE IN THE RUSSIAN FEDERATION

Abstract

This study attempts an in-depth analysis of the impact of digitalization on the institution of civil law in the Russian Federation. Special attention is paid to the key role of information technologies in modern society, as well as their impact on the legal mechanisms of conclusion and execution of contracts. Taking into account the accelerated development of digital technologies with their gradual introduction into various spheres of society and the economy, we see a situation when electronic contracts are assigned an increasingly significant role in the organization of civil legal relations. The study provides an in-depth analysis of the main aspects of electronic contracts, their legal status in the modern Russian legislative system. Taking into account the identified problems and analysis of the current national legislation, constructive recommendations have been developed to improve the mechanism of regulation of electronic contracts in the modern legal space of the Russian Federation. These recommendations are aimed at ensuring timely effective protection of the rights of all subjects of civil-law relations in the digital environment. In particular, the recommendations touch upon the issues of strengthening the security of electronic means of signing and authentication, development of mechanisms of electronic accounting and fixation of contractual obligations, as well as improvement of tools to protect the rights of consumers and entrepreneurs in the electronic space.
