Abstract

The article examines the civil law community as one of the subjects of civil law, whose participants commit acts of will with the help of the decision of the meeting. The author has put forward a hypothesis that the formation of the legal personality of a civil law community represents a specific process: the consolidation of the will of its individual members in a specially regulated procedure. Association into such an entity is assumed on the basis of common interests and goals of physical entities. The objective of the article is to analyze the volitional act (decision) of the community as a special subject of contestation in a civil legal context. The relevance of the work is accounted for by the need for an in-depth understanding of law enforcement practices in the context of modernizing the norms of the civil code of the Russian Federation, in particular, the importance of norms relating to decisions of meetings of civil law communities. The analysis of these aspects will be instrumental in extending expertise concerning the process of forming the common will of community participants, as well as in providing more profound understanding of the legal issues associated with the activities of these entities.
